postmortem examination which was conducted by Dr. Anita Verma (PW-9)who gave her report EX. P—16 stating therein that no definite opinion regarding came of death could be given as the body was decomposed. During investigation, memorandum of the accused/appellant Ex. P-3 was recorded on 18.9.2006 in which he stated that as by demanding back Rs. 30,000/— the deceased was creating an awkward situation to him, he called him in the name of giving back money, administered Iariyago injunction and after he became unconscious, took him to the field and kept pressing his back in the water till death and thereafter he returned to his dispensary. Vide Ex. P—4 one fullpant smeare, with mud and a phial containing 30% medicine were recovered based on'- the~memorandum of the accused. Viscera was sent to Forensic Science La b” tory for chemical ‘ examination and as per u x hibited report no chemi c“, found in it. However, in the phial and syringe cholo-rquene was found. After merg inquiry, FIR, E —18 was registered on 18.9.2006 against the accused under Section 302 IPC. After completion of investigation, charge sheet was filed fo e offence under the said section followed by framing of charge accordingly. 3. ln order to prove the complicity of the accused/appellant in the crime in question, to} prosecution has examined 12 witnesses. ' Statement of the accused/appellant under Section 313 Cr.P.C. was also recorded in which he denied his guilt and pleaded innocence and false implication in the case.
