Counsel for the petitioner fairly submits that the order impugned is appealable order and appeal lies before the Collector. He submits that the petitioner may be permitted to withdraw this petition with liberty to file appeal

before the Collector. However, the Collector be directed to not only decide the appeal of the petitioner expeditiously but also to consider the interim application likely to e filed by the petitioner.
State counsel has no objection to the above preposition as put forth by the petitioner.
Accordingly, the petitioner is permitted to withdraw this petition with the aforesaid liberty. Needless to state that in the event of filing application by the petitioner, same would also be considered in accordance with law.
It is made clear that this Court has not expressed anything on meirts of the case and the authority concerned would be at liberty to decide the same in accordance with law.
