The present writ petition was preferred challenging the order dated 25/06/2008 whereby the respondents No. 3 to 7 have been promoted to the post^{ofUpperDivisionTeacher.} Petitioner has also sought for a direction to the respondents to consider his case for promotion on the said post.

In the return filed by the State Govt. it is mentioned that after correction of the entry’of date of appointment of the petitioner, a fresh gradation list was issued on 01/04/2006 and thereafter he has been granted promotion on the post^{ofUpperDivisionTeacher} on 18/08/2008 (Annexure R-1).

In view of the above, the relief claiming consideration of his case for promotion^{hasbeenrendered} infructuous.

At this stage, Shri Deshmukh, learned counsel for petitioner would submit that since the petitioner^was denied promotion only on account of incorrect entry of his date of appointment in the gradation list, he is entitled for promotion^fromthe date when juniors to him were promoted, therefore, the petitioner^maybe permitted to move a representation before the competent authority on this aspect of the matter.

Considering the submission of Shri Deshmukh, the writ petition is disposed of with a direction that in the event petitioner moves a representation within a month, seeking seniority from the date persons junior to him have been promoted as Upper Division Teacher, the competent authority shall decide the representation on its own merits in accordance with ‘ law as soon as possible preferably^Withina period of three months from the s, 2 T" date of submissmn ofre p resentation W’^#2J r ’7 SdlP rashant^KumarMishra Judge
