earlier committed eve-teasing (Wm)withthecomplainant's sister and gave threat when the complainant protested for the same, came there when the complainant was standing outside the pond and by using filthy words to the complainant assaulted him by a sickle at his neck; the complainant tried to save him, he also sustained injuriesinhisbothofthehands.Theincidentwas seen by some villagers thosewhowere presentatthetimeofincident.The complainant lodged FIR at Civil Lines, Raipur which was written as an unnumbered First Information Report‘(Ex.—P/3); subsequently,the Civil Lines, Raipur‘piolice registered the case under Section 307 of the IPC againstthe (Ks ~ appellant by 98 nd started investigation. On the next day, i.e., 26-5-98 the complainant was discharged. During the investigation, spot map was prepared vide Ex.-P/10.Statementsof the witnesses were recorded under Section 161 of the Code of Criminal . Procedure, 1973 (forshort‘theCode’).Theappellantwasarrested.Thebed head ticket (Ex.-P/13) was collected from the hospital. After completion of the investigation, police filed the charge sheet before the Chief Judicial Magistrate, §aipur on 27—6-98, who, in turn, committed the case to the Court of Sessions, Raipur, the learned Additional Sessions Judge received the case on transfer and conducted the trial. He framed charge under Section 307 of the IPC againsttheappellant.Theappellantdeniedthechargeandprayedfortrial.
