3-1-2008 examination for conducting recruitment of Shiksha Karmis was held on 15-4-2008. Result of the Shiksha Karmi Grade-III with which this Court is concerned'in this writ petition was declared on 10-6-2008. After declaration of the result, required number of Shiksha Karmis were appointed and waiting list was also published. The present dispute arises out of subsequent counseling and appointments in pursuance thereto for filling up 290 posts of Shiksha Karmis Grade-III in various schools under Janpad Panchayat, Kartala, District Korba. The order of appointment was purportedly issued on 30th June, 2009 though according to the respondents, it was in fact issued on 14th July, 2009 by mentioning the date 30th June, 2009. After the said counseling and letter of appointment was issued, complaints were made before the Collector and suo motu revision proceeding was drawn. Considering the enormity of the illegalities, the Collector, Korba directed for enquiry and submission of report by the Additional Collector along with Assistant Cominissioner, Tribal Development and the District Education Officer as its members. By the impugned order (Annexure-P/1), the Collector, Korba in exercise of powers under Section 85 of the CG Panchayat Raj Adhiniyam, 1993 (for short^'the Act') suspended the execution of order of appointments after mentioning that an enquiry has been constituted and the ruatter is serious involving large scale irregularities/illegalities.

clear as to who prepared the reservation roster and on whose instructions it was prepared.

Individual notices to the candidates ^yere not issued and the intimation for counseling scheduled to be held at 10.30 am on 30to June, 2009 was published in the local edition of newspapers on 29-6-2009 even though the candidates of other districts have also appeared and were placed in the waiting list.

From the record, it does not appear that as to at which level this decision was taken that intimation shall be sent through newspapers and that too merely one day prior to the date of counseling and not by se.nding individual intimation to the candidates. .

From the last appointee mentioned in the list, it is found that sixty two candidates placed above him have been declared absent in the counseling. Therefore, a conclusion has been drawn by the Enquiry Officer that if individual notices would have been issued, such huge absence of candidates would not have been possible.

It is found that though the counseling is said to have taken place on 30th June, 2009, but froin the record submitted during the enquiry, it has come out that CEO Janpad Panchayat informed that the counseling was suspended on the said date and the appointment orders were not issued. The Chief Executive OfEcer went on leave from 3-7-2009 and came back to re-join on 13-7-2009 and it is possibly after this date, the appointment orders have been issued, but the date mentioned over the appointment orders was 30th June, 2009. case of Krishan Yadav applies to the facts of the present^case. The Railway Boards decision to cancel the selection cannot be faulted with. The appeal therefore deserves to be allowed."

13.8imilar is the law laid down by the Hon'ble M.P. High Court in the matter of Sint. Manita Pateria and others Vs. State of M.P. and others {2002 (5) M.P.H.T. 76}.

14.In the present case also, the illegalities are .widespread and allpervasive, therefore, non-issuance of individual notices before exercising the powers under Section 85 of the Act does not vitiate the exercise of powers. Apart from this, it is also to be seen that prior approval of the entire selection/appointn'ient by the General Administration Committee of the Janpad Panchayat is necessary, however, in the present case, no such approval was obtained, therefore, the appointment was othenvise also contrary to the rules and the Collector has rightly held in his subsequent order dated 11-8-2009 (Annexure-R/3) which has not been challenged by the writ petitioners that the order of appointment and the entire proceeding of counseling was void ab initio and non est.

IS.With regard to argument regarding exercise of powers under Section 85 of the Act, it is to be seen that under the said provision, the competent authority has powers to suspend the execution of any resolution passed, order issued, licence or permission granted or prohibit the performance of any act by a Panchayat, if in his dpinion such resolution, order, licence, permission or act has not been legally passed, issued, granted or authorized. In the present case, on receipt of complaints, the Collector has found that large-

scale irregularities and illegalities have been comraitted at the dme of counseling and, therefore, having been satisfied about preexistence of conditions for exercising his powers under Section 85 of the Act, the impugned order has been passed, therefore, the arguments advanced by learned counsel for the petitioners are not acceptable.

16.In view of the above, there is no substance in these writ petitions
