Learned advocate appearing for the petitioner submits that the subject matter of the instant case relates to alleged recovery of 96 bottles Choco Cough Syrup, charge-sheet has been submitted and charges have also been framed, however, witness action has not commenced.

Learned advocate appearing for the State opposes the prayer for bail and submits that the prosecution has relied upon 16 witnesses in order to prove its case.

I have taken into account the quantum of seizure and the period of detention which is 9 months 15 days. Having considered the same, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. The petitioner,

If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Murshidabad without prior permission of the learned special court.
