Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 5 months, chargesheet has been submitted and there has been no recovery from the present petitioner and has been implicated on the basis of statement of the co-accused.

Learned advocate for the State opposes the prayer for bail and submits that the alleged recovery in the present case is of 414 grams of brown sugar.

I have taken the report which has been submitted by the investigating officer of the case and is of the view that the petitioner’s involvement in the present case is restricted to statement of co-accused and there has been no alleged recovery. As such, the prayer for bail of the petitioner is allowed. The petitioner,

namely, Salman Sk shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4^th Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court.

Thus, CRM(NDPS) 834 of 2026 is allowed.
