The office report reveals that the petitioner as well as the opposite parties refused to accept the notice sent to them.
This criminal revision challenges the judgement and order passed by the learned Additional Chief Judicial Magistrate, Arambag, Hooghly in M.C. No. 83 of 2001 under Section 125 of the Cr. P.C. on 09.11.2006. By the impugned judgement learned Additional Chief Judicial Magistrate was pleased to grant maintenance to the petitioner to the tune of Rs.1000/- per month and Rs. 500/- per month for the maintenance of her minor daughter. The opposite party / husband by filing this application under consideration has challenged the impugned order.
Briefly stated depicting herself as neglected wife of Shri Uday Ranjan Ghosh Smt. Ratna Ghosh filed an application under Section 125 of Cr.P.C. before the learned S.D.J.M. Hooghly, as then was, stating inter alia that she has been deserted by her husband while she was carrying, even after the birth of the child, her husband did not discharge his duty as father. The opposite party contested the proceeding by filing written objection, however, admitting status of the petitioner as his wife. As husband, the petitioner, however, has the obligation to maintain his wife and
minor daughter, particularly when the wife does not have any income or source of sustenance sufficient to maintain herself.
Under such circumstances, I do not find any reason to interfere with the order impugned.
This revisional application, stands dismissed being bereft of
merit, however, without any order as to costs.
Let a copy of the order be sent to the learned Trial Court for information and necessary action.
