This petition is filed with a main prayer i.e. prayer clause (D) for direction to the respondent No.2 – The Deputy Commissioner of Police, Zone – IX, to either personally conduct investigation or to appoint a senior, uninfluenced officer under his direct supervision and control to investigate C.R.No. 1249 of 2025 dated 27^th September,

During pendency of this petition, the respondent No.2 has passed an order transferring the investigation to Mr. Sachin Bandgar, Police Inspector (Crime), Amboli Police station.

In this view of the matter, at this stage, the newly appointed investigating officer needs to be given sufficient opportunity to investigate the offence. The main prayer clause (D) thus stands satisfied.

As far as the other prayers are concerned, at this stage, it is not necessary to consider those prayers because the main concern is about proper investigation. In fairness, learned Counsel for the petitioner is not pressing prayer clauses (A), (B), (C) and (E), at this stage.

officer directed by the respondent No.2. In addition, we also direct the respondent No.2 to monitor and supervise the investigation in this offence.

It is needless to add that the newly appointed investigating officer shall have free hand in carrying out the investigation in accordance with law including addition of necessary provisions of law.

With these directions, the petition is disposed of.
