A cumulative reading of Section 41, Section 42 and Rule 129 of the Bombay Forest Rules, 1942 shows that transit of forest-produce in contravention of the conditions of the pass is transit in contravention of the rules and, once an act or omission is made an offence under a rule framed under the Forest Act, 1927, it is a forest-offence within Section 2(3); accordingly, a forest-offence under Section 42 read with Section 41 and Rule 129 was prima facie made out.
