The opponent is hereby directed to pay educational fees, child’s transportation fee, either directly in the school or he shall reimburse after producing original receipt by applicant.

The opponent shall continue to contribute Rs.10,000/per month towards groceries.

The opponent shall pay child’s L.I.C. premium of Rs.69,500/- whenever due.

The opponent shall pay Rs.50,000/- per month to the applicant towards travelling, petrol, hotelling, medical expenses, vaccination etc., till further order.

The opponent shall deposit the amount of maintenance as above in the account of applicant on or before 10^th day of each month as per English Calendar.”

In Writ Petition No.17401 of 2024 filed by the wife - Poojalaxmi Angad Ghule, the challenge is to the aforesaid Order dated 4th July 2024 as also Order dated 19th October 2024 passed by the learned Judge, Family Court No.2, Pune in Petition No. Civil M.A. - 69 of 2024 which has been filed seeking Review of the said Order dated 4th July 2024.

One of the contentions raised by Mr. Sarwate, learned Counsel for the wife is that although the learned Judge of the Family Court has recorded the finding that the wife has concealed her income, however,

the said finding is recorded without giving any reasons.

On the other hand, Ms. Thadhani, learned Counsel for the husband, states that actually the wife has concealed her income and there are documentary evidence to substantiate the said contention.

However, after noticing that the learned Judge of the Family Court has not given any reason to record the said finding, both the learned Counsel, on instructions, state that the following Order be passed by consent.

i. Impugned Order dated 4th July 2024 passed by the learned Judge, Family Court No.2, Pune, below Exhibit-14 in Petition No. A-283 of 2023 as also the Order dated 19th October 2024 passed by the learned Judge, Family Court No.2, Pune, in Petition No. Civil M.A. - 69 of 2024, are quashed and set aside.

ii. Application bearing Exhibit-14 filed in Petition No. A-283 of 2023 is restored to the file of the learned Family Court, Pune.

iii. As the Order dated 4th July 2024 passed below Exhibit-14 in Petition No. A-283 of 2023 is quashed and set aside, nothing survives in Petition No. Civil M.A. - 69 of 2024 and the same is disposed of as infructuous.

of Mr. Angad Mahendra Ghule, husband, who is personally present in the Court, states that the husband will comply with Clause No.2 of the Order dated 4th July 2024 till the said Exhibit-14 Application is decided afresh. She further submits that apart from the said payment the husband will also comply with ad-interim Order dated 28th August 2024 passed by this Court. All these statements made by Ms. Thadhani, learned Counsel for the husband - Angad Mahendra Ghule, made on his instructions, who is personally present, are accepted as undertakings given to this Court.

The learned Judge of the Family Court, is requested to dispose of Exhibit-14 Application filed in Petition No. A-283 of 2023 expeditiously, within a period of 4 months.

It is clarified that the contentions of both the parties on merits are expressly kept open.

¶42

Both the Writ Petitions are disposed of in above terms with no order as to costs.
