By this writ petition, the petitioner challenges the judgment dated 08/06/2025 passed by Respondent No. 2 / Scrutiny Committee, by which the tribe claim of the petitioner, belonging to ‘Koli Mahadev’, has been invalidated.

Learned counsel for the petitioner drew our attention to the order dated 24/07/2024 passed in Writ Petition No. 7598 of 2024 in the case of Shraddha Shrikrushna Khanapurkar vs. State of Maharashtra and another and submitted that the validity holder in that case is the petitioner’s real sister, who has been granted conditional validity by this Court. He therefore submits that the petitioner also deserves to be granted conditional validity.

The learned AGP does not dispute the above fact nor the relationship of the petitioner with the conditional validity holder in Writ Petition No.7598 of 2024.

In that view of the matter, we pass the following order:

ORDER

(i). The writ petition is partly allowed.

(ii). The impugned order dated 08/06/2025 passed by respondent No.2 / Scrutiny Committee is quashed and set aside.

iii) The respondent No.2 / Scrutiny Committee shall immediately issue tribe validity certificate to the petitioner as belonging to ‘Koli Mahadev’ scheduled tribe in the prescribed proforma without adding anything. The validity shall be subject to outcome of the matters which the Scrutiny Committee has decided to re-open.

(iv) The petitioner shall not be entitled to claim equities.
