Sow Rameshwari W/o Pramod Komalwar vs Pramod S/o Purushottam Komalwar And Others

As per the compromise pursis Exhibit-“X”, the applicant / wife and the non-applicant / husband, agreed to settle the matrimonial dispute in the following terms:-

I. The applicant has agreed to withdraw the proceedings before the Family Court, Nanded bearing Petition No.E/100/2021 seeking maintenance for herself and for her son.

II. The Applicant has agreed to withdraw P.W.D.V.A. Proceeding No.85/2023 pending before the J.M.F.C. Nanded against the Non-applicant and his family members.

III. The Applicant has agreed to give consent for quashing of Regular Criminal Case No.74/2023 arising out of F.I.R. No.58/2023 under section 323, 498-A, 504, 506 and 34 of Indian Penal Code.

IV. The applicant has agreed to give consent for mutual divorce to the Non-applicant in H.M.P. No.119/2023, which is pending before the Hon’ble 6^th Joint Civil Judge (Senior Division), Chandrapur. The applicant further agrees that she would go to the Court of Chandrapur for giving her consent without any delay to facilitate the

disposal of divorce proceedings and for obtaining a decree for dissolution of marrriage.

V. The Non-applicant has agreed that, the child custody will remain with the wife i.e. applicant and also agreed to withdraw the Civil Misc. Application No.14/2022 before the Ld. Principal District Judge, Chandrapur for custody of child i.e. son.

VI. The Non-applicant has agreed and will request Ramesh Nagannaji Komalwar for withdrawal of proceeding Reg. Civil Suit No.201/2025 pending before the Ld. Civil Judge, Senior Division, Chandrapur for recovery of compensation / damages against the Applicant and others.

VII. Non-Applicant has agreed to provide his documents if required for the purpose of education and for Caste Validity of son of the applicant and non-applicant.

VIII. As per the re-conciliation between the parties, the NonApplicant is going deposit Rs.43 lakh through D.D. No.116672 in the name of the Registrar High Court Bench at Aurangabad towards full and final settlement for the maintenance of applicant and son of applicant and nonapplicant. The applicant henceforth will not claim any amount of maintenance from the Non-applicant for herself or for her son as of today and in future.

Accordingly, the non-applicant / husband has deposited

the Demand Draft of Rs.43,00,000/- (Rupees Forty Three Lakh) with the Registry of this Court.

Since the parties have amicable settled the matrimonial

dispute in terms of compromise pursis Exhibit-“X”, therefore, it will be just and proper to dispose off both these applications in view of compromise pursis.

The applicant / wife would be entitled to withdraw the amount as per the terms and conditions prescribed in the compromise pursis.

Both the Miscellaneous Civil Applications are disposed
