Bombay High Court (OOCJ), Abhay Ahuja, J. (order dated 28 April 2026): In six Execution Applications (Nos. 404, 2554, 2607, 2553, 2573 and 2552 of 2025) with connected Interim Applications, Tata Capital Limited (Applicant) submitted that the underlying awards flowed from a unilateral appointment of the Arbitrator, invoking the Hon'ble Supreme Court's decision in Bhadra International (India) Pvt. Ltd. and others v. Airports Authority of India, 2026 SCC Online SC 7, wherein it was observed that unilateral appointment of arbitrator is void ab initio and the ineligibility can be raised at any stage and even in execution. Acting on this, the Court set aside the respective awards and the Execution Applications and connected Interim Applications stood dismissed/disposed. The parties were left free to initiate fresh arbitration proceedings in accordance with law, and the period from the invocation of the arbitration till the date of the order was directed to be excluded for purposes of limitation in such fresh proceedings. When the matters are called out, Ms. Gogri, learned Counsel, appearing for the Applicant submits that in these matters there has been a unilateral appointment of Arbitrator and this Court may pass appropriate orders in view of the decision in the case of Bhadra International (India) Pvt. Ltd. and others vs. Airports Authority of India¹ where the Hon’ble Supreme Court has clearly observed that unilateral appointment of arbitrator is void ab initio and the ineligibility can be raised at any stage and even in execution.

In view of the aforesaid, the respective awards are therefore set aside and the Execution Application as well as the connected Interim Application stand dismissed/disposed.

It would be open to the parties to initiate fresh arbitration proceedings in accordance with law.
