order for issuing notice under the Contempt of Courts Act, 1971 to Respondent Nos.3 and 4, returnable on 17^th December, 2025. Today, none of these two Respondents are present in the Court hall.

The Judgment of the Writ Court dated 1^st October, 2025, was assailed in Petition for Special Leave to Appeal (C) No.38692-38694 of 2025 (Union of India & Ors. Vs. Sushant Bhausaheb Sarode Etc.) . By order dated 16^th January, 2026, these three SLPs were dismissed on the ground that the Hon’ble Court did not find a good ground to interfere with the impugned Judgment delivered by this Court.

The learned Advocate for the Petitioners in these Contempt Petitions submits that the Petitioners will now have to be subjected to a Detailed Medical Examination ( ‘DME’ ) and

verification of documents. Thereafter, they would be subjected to the training course, if they clear DME . According to the Petitioners, the training is scheduled in two batches, beginning from 9^th February, 2026 and 16^th February, 2026.

The learned Advocate for the Union of India submits on the basis of the averments in the affidavit in reply to these Contempt Petitions, dated 16^th December, 2025 filed through Mr. Narinder Paul, pointing out from Paragraph No.10 that CRPF is empowered to undertake such tests and communicate the results to the Staff Selection Commission for preparation of the final merit list. On instructions from Mr. Sukhendra Singh Somawanshi, Deputy Commandant (Law) present in the Court hall, it is submitted that a Special Medical Board would be constituted for conducting the DME with regard to these Petitioners within a period of four weeks. If they clear the said examination, they would be subjected to training as like any other candidate for the same duration and the same course and they would not be deprived of any portion of the training.

Since we are informed that the DME would be conducted within 30 days from today, the learned Advocate for the Petitioners submits on instructions, that the contempt be purged and these Petitions may be disposed off because the Petitioners do not have any interest in pursuing the contempt when justice is being done to them.

Since the contemnors belong to the Military services, out of magnanimity, we are not issuing bailable warrants against them, though they are not present in the Court. Their presence is excused.

In view of the above, the contempt is purged. All these
