The Respondent/original Appellant has filed an undertaking on affidavit of one Ajay C. Ruge, who is Service Territory Manager Retail Goa of the original Applicant Bharat Petroleum. The undertaking states that the original Applicant shall not carry out any work or continue to carry out any work at the site i.e. the suit property bearing Chalta No. 148 of P.T. Sheet No. 189 admeasuring 1014 m2 and Chalta Noo. 86 of P. T. Sheet No. 189 admeasuring 78 m2 without obtaining appropriate and necessary permissions from the Margao

Municipal Council and it further undertakes that such work would be carried out strictly in accordance with law. The undertaking is accepted by this Court and it is clarified that the undertaking shall relate to any work that may be carried out in the suit property.

It is further clarified that in the event such permissions are obtained or are granted to the Respondent/original Appellant to carry out the work the same shall be undertaken only after specific permissions to that effect are granted by this Court and after placing on record the permissions and the plan under which such permissions are granted.

In view of the undertaking given and accepted above, the application stands disposed of in these terms.
