By this Application, the Applicant is seeking regular bail in Crime No.0249/2025 registered with Bhadrakali Police Station, District Nashik for the offences punishable under Sections 109, 115(2), 352, 351(2),351(3) r/w. 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is prosecution's case that on 30/06/2025, Applicant and coaccused assaulted the brother of the first informant with sickle with intention to kill him on the ground of old dispute.

It is contention of learned counsel for the Applicant that Applicant has no antecedents. He is behind bars for more than eight months. There is no progress in the trial. It may take time to conclude the trial and requested to allow the application.

It is contention of learned APP that Applicant assaulted the brother of the first informant with sickle on his neck with intention to kill him. The injuries are grievous. If Applicant is released on bail, he may threaten the prosecution witnesses and requested to reject the application.

Learned counsel for Respondent No.2 submits that matter is settled out of the Court and he has no objection to allow the bail application.

I have heard all learned counsel. Perused charge-sheet and documents produced on record.

Applicant is behind bars for more than eight months. There is no progress in the trial. Investigation is completed and chargesheet has been filed. Applicant has no antecedents.

Considering these facts, I pass following order.

ORDER

(i) The Applicant- Firoz Yusuf Shaha @ Bhiku be released on bail

in Crime No.0249/2025 registered with Bhadrakali Police Station, District

Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Bail Application is allowed in the aforesaid terms.
