Bombay High Court (R.M. Joshi, J.), Criminal Bail Application No. 4628 of 2024 (pronounced 24.03.2026) - bail application under the NDPS Act dismissed. The Applicants were intercepted at CSMI Airport, Mumbai on 09.12.2021 on specific intelligence (Ethiopian Airlines Flight No. 80-610); 16.464 kg of heroin was found in Applicant No. 1's bags ('C' and 'D') and 18.526 kg in Applicant No. 2's bags ('A' and 'B'), totalling 34.452 kg (FIR No. 127/2021, Airport Intelligence Unit, Mumbai; Ss. 8(C) r/w 21(c), 22, 27(A), 23 r/w 28, 29 NDPS Act). Holding: (1) since commercial quantity was seized independently from each Applicant's conscious possession, the Section 37 embargo applies; (2) prima facie compliance of Section 42 shown by the intelligence note naming the Applicants and the superior authority's sanction; (3) no Section 50 non-compliance - the panchanama records individual intimation to each Applicant of the right to be searched before a Gazetted Officer/Judicial Magistrate, waiver, and signatures of panches and Applicants (applying Ranjan, 2023 SCC Online SC 1262); (4) post-testing mixing of homogeneous samples into one packet is permissible under Rule 10 of the 2022 Rules, questions of homogeneousness and CA-report evaluation being left to trial; (5) the 40-day delay in sending the inventory/samples to the Magistrate under Section 52A is at most a procedural irregularity and no ground for bail, the parcels having reached the CA in sealed condition (adopting NCB v. Kashid, Criminal Appeal No. 5544/2024); (6) the CA report detecting Diacetylmorphine (Heroin), 6-monoacetylmorphine, Acetylcodeine and Caffeine does not, at the bail stage, negate recovery of 34.452 kg of heroin; (7) over three years' incarceration with charge framed about a year earlier and trial not commenced is not by itself a ground for bail under the Section 37 regime (State of MP v. Kajad, 2001(7) SCC 673; NCB v. Mohit Aggrawal, (2022) 8 SCC 374). Application dismissed; the trial court was requested to expedite the trial and conclude it at the earliest. The prosecution put the seizure's worth at Rs. 2,41,16,40,000/-.
