It is prosecutions’ case that Applicant murdered his wife, locked the door of the house from outside and ran away. He disclosed about murder of his wife to the first informant.

applicant is behind bars for more than four years. There is no progress in the trial. Applicant has no antecedents. Prosecution case is based on circumstantial evidence and requested to allow the application.

It is contention of learned APP that Applicant murdered his wife and locked the door of the house from outside and ran away. There are eye witnesses, who saw the applicant locking the door. Applicant informed the first informant about murder of Applicant’s wife. Charge is framed. He submits that if applicant is released on bail, he may abscond or threaten the prosecution witnesses and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record. The prosecution case is based on circumstantial evidence. To prove the case against the Applicant, evidence is required. He has no antecedents. He is behind bars for more than four years. It may take time to conclude the trial.

Considering these facts, I pass following order:

ORDER

(i) The Applicant- Shyam Ramu Dere be released on bail inCrime No. 149/2022 registered with Nigdi Police Station, District Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
