2. Hence, I have taken a copy of the Application from the

Learned Counsel so as to not inconvenience the parties.

3. By way of the present Application, the Applicant seeks

immediate Medical Examination and treatment of the Applicant at a Government Hospital to address his alleged deteriorating health condition.

the first Report dated 26^th September, 2025 issued by the Chief

Medical Officer of the Thane Central Prison, Thane, records that the Applicant was evaluated and it was found that he was moderately weak and unable to stand on his own feet. He was not responding to any communication and not able to comprehend the commands given. He appeared to be in delirium and required higher investigation like CT scan / MRI which are not available at the Hospital. The patient also required ICU management in the interests of his medico-legal case and for better treatment and management. The Applicant was thus referred to the J. J. Hospital.

5. The second Report by covering letter dated 27^th November, 2025 also under the signature of the Medical Officer, Thane Central Prison, recorded that the Applicant was sent to the J. J. Group of Hospitals for further Psychiatric opinion and the Report from the J. J. Hospital recorded that the prisoner has Psychosis NOS and he was advised medicine and neurology opinion in view of the fact that he was unable to stand on his own feet and was not able to understand commands.

6. The third Report dated 24^th December, 2025 also records

that the Applicant was sent once again to Sir J. J. Group of Hospitals, Mumbai. He was seen by Neurology OPD and was given treatment.

7. Today, Ms. Bhosale, learned APP, has placed on record another Report dated 26^th December, 2025 from the Board of Doctors of Sir J. J. Group of Hospitals. The said Report records that his general condition is fair and vitally stable and during his stay in the ward the Applicant had normal sleep and appetite. The Mental Status Examination indicated that he had a staring look and he was conscious but minimally co-operative and minimally communicative. The impression, as recorded in the Report, states that he has unspecified catatonia. The Board of Doctors has advised regular treatment and follow-up.

8. Despite these Reports, Mr. Tanmay Mandot, learned Counsel appearing for the Applicant, insists that the Applicant is not able to stand on his own feet, is totally disoriented and also unable to comprehend the commands given by any person.

9. In view of the Reports of the Medical Doctors, I deem it

appropriate to direct that the Applicant be admitted to the Regional Mental Hospital, Thane, initially for a period of one month so that the Applicant may be given appropriate treatment.

10. After the expiry of the period of one month, the Doctors in the Regional Mental Hospital, Thane, at their discretion, shall take a decision as to whether the Applicant can be discharged or is needed to be retained by the Hospital for further treatment.

11. The mother and the brother of the Applicant are permitted to visit the Applicant on every alternate Saturday as per the visiting hours of the said Hospital.

12. At the end of one month, the Hospital to submit a Report on the health status of the Applicant.

13. Stand over to 9^th February, 2026.
