This is an application for regular bail.

¶10

The applicant came to be arrested in Crime No.461 of 2024 registered at Yerwada Police Station, Pune for the offences punishable under Sections 103, 3(5) of the Bharatiya Nyaya Sanhita, Section 4 and 25 of the Arms Act and Section 37(1)(2)(3) and 135 of the Maharashtra Police Act.

It is the case of the prosecution that on the date of incident which took place on 17^th July 2024, on account of previous enmity the present applicant and other co-accused assaulted the deceased by Koyta, chopper etc. and committed his murder.

I have heard the learned counsel for the applicant and the learned APP for the respondent – State.

Learned counsel for the applicant submits that the applicant is a student. It is submitted that the alleged eye-witnesses have

not attributed any overt - act to the present applicant. It is further submitted that the applicant is in jail for about 1 and ½ years and the trial is still at the stage of framing of charge only.

On the other hand, learned APP for the respondent/State submits that the applicant is involved in serious crime of murder. It is submitted that at the time of alleged incident, the applicant was armed with weapon. It is submitted that considering the nature of crime, the applicant may not be released on bail.

I have perused the statements of eye-witnesses. They have not attributed any specific overt-act to the present applicant. The applicant is a student. There are no other criminal antecedents against the applicant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed.

A] The Application is allowed.

B] The applicant be released on bail in C.R. No. 461 of 2024 registered at Yerwada Police Station, Pune for the offences punishable under Sections 103, 3(5) of the Bharatiya Nyaya Sanhita, Section 4 and 25 of the Arms Act and Section 37(1)(2)(3) and 135 of the Maharashtra Police Act on furnishing P.R Bond in the sum of Rs.25,000/(Rupees Twenty Five Thousand) with one or two sureties in the like amount.
