By this application, the Applicant is seeking regular bail in Crime No. 28 of 2025 registered with Lonavala Rural Police Station, for the offences punishable under Sections 316(2), 318(4), 64(2)(m) and 69 of Bharatiya Nyaya Sanhita, 2023 (for short “BNS Act”)

It is prosecution’s case during period 15.09.2023 to 21.01.2025, the applicant sexually assaulted the first informant on the promise of marriage. It is alleged that the applicant had taken Rs.29,90,000/- from the first informant and cheated her.

It is contention of learned counsel for the applicant that the applicant is behind bars for around one year. The applicant has paid Rs.10 lakh to the first informant and the physical relations between the applicant

and first informant were consensual. The applicant has no antecedents. It may take time to conclude the trial and requested to allow the application.

It is contention of learned APP that the applicant sexually assaulted the first informant on the promise of marriage. If the applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the application.

It is contention of learned counsel for respondent No.2 that respondent No.2 has received D.D. of Rs.10 lakh, hence appropriate order be passed.

I have heard both the learned counsel. Perused chargesheet and documents produced on record. The applicant is behind bars for around one year. The applicant has no antecedents. To prove the case against the applicant, trial is required. As allegations against the applicant are that he sexually assaulted the first informant on the promise of marriage. It is also noted that out of alleged cheated amount, the applicant has paid Rs.10 lakh to the first informant. Considering these aspects, I pass following order.

ORDER

i. The applicant be enlarged on bail in Crime No. 28 of 2025 registered with Lonavala Rural Police Station, on executing P.R.Bond of Rs. 30,000/- on furnishing one

or two sureties in the like amount.

¶26

ii. The applicant shall attend the concerned police station as and when required.

¶27

iii. The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

iv. The applicant shall not contact victim and prosecution witnesses.

¶29

The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
