The applicant came to be arrested in connection with Crime No.1019/2025 registered with Kalmeshwar Police Station, District Nagpur for the offence punishable under Sections 109, 118[1], 189[2], 191[2], 191[3], 190 of the Bhartiya Nyaya Sanhita (BNS) and Sections 3, 4 and 25 of the Arms Act.

It is alleged that so far as the present applicant is concerned, he has sold the firearm to one Amrit Tufansingh

Order

Bhada, and said Amrit has sold said weapon to Deva Gujar through one Chandrashekhar @ Rohit. This fact was revealed when statement of co-accused namely Amrit Bhada was recorded. Except for this, there is no material against the present applicant.

This Court by order dated 27.01.2026 passed in Criminal Application No.1449/2025 (Amrit Tufansingh Bhada .vrs. The State of Maharashtra) has already granted bail. Role of the present applicant is also similar to that of Amrit Bhada i.e. selling of fire arm and name revealed on the basis of the statement of the co-accused, however, there is no other material except this against the applicant. In this view of the matter, I am inclined to grant the bail, hence following order.

(i) Criminal application is allowed and disposed of.

(ii) The applicant/accused Jaspalsingh Charatsingh Bawari be released on bail in connection with Crime No.1019/2025 registered with Kamleshwar Police Station, District Nagpur for the offence punishable under Sections 109, 118(1), 189(2), 191(2), 191(3), 190 of the Bhartiya Nyaya Sanhita and Sections 3, 4,

25 of the Arms Act on his furnishing personal bond in the sum of Rs.25,000/- with one solvent surety in the like amount

(iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.

(iv) The accused shall provide his residential address and cell number to concerned Police Station and shall not change his place of residence without prior intimation to the concerned Investigating Officer.

(v) The applicant/accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail.

(vi) The applicant/accused while on bail shall not commit similar type of offence.

(vii) Misc. Applications, if any, are also disposed of.
