Sahil Ramesh Sonavane v. State of Maharashtra and Anr.
Case brief
What is this about?
Atrocities Act 1989; Section 15A(3) notice to victim; Section 15A(5) hearing of victim; ad-interim bail; anticipatory bail; Special Court Kalyan; Section 18 embargo; Article 21 liberty; balance of victim rights and accused liberty; interim protection pending notice; Sudip Mondal Calcutta High Court; Kishor Shivdas Shinde Bombay HC division bench; Jeewanlal beneficent construction; Union of India v State of Maharashtra; Criminal Appeal 951 of 2025; R. M. Joshi J; appeal disposed as infructuous.
What did the court decide?
Section 15A entitles the victim/informant to reasonable, accurate and timely notice of any proceeding including bail, but, unlike Section 18 which creates a complete embargo on anticipatory bail where a prima facie offence under the Atrocities Act is made out, Section 15A creates no such embargo on the court's power to grant ad-interim/urgent relief.
