The applicant is apprehending his arrest in Crime No. 456 of 2025 registered at Kharghar Police Station, for the offences punishable under Sections 108 & 85 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The deceased was the wife of the present applicant. It is the case of the prosecution that when the applicant came to the

house of the deceased with a proposal of marriage, he told the

deceased and his family members that his first wife died due to complications during pregnancy, even though she was alive. It is alleged that the deceased, after coming to know about the said fact, when enquired about it, the applicant started harassing her. There are allegations of harassment against mother-in-law, who is also co-accused in the present crime. It is alleged that, due to constant harassment caused by the applicant and other coaccused, on 05.11.2025 the deceased committed suicide by hanging herself.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that admittedly it was the second marriage of the deceased with the applicant. It is submitted that there is a delay of eight days in lodging the FIR and therefore possibility of afterthought allegations cannot be ruled out. It is submitted that there is no need of custodial interrogation and the applicant is ready and willing to co-operate in the investigation.

On the other hand, the learned APP for the respondentState submits that the deceased committed suicide within a period of seven months of marriage. The learned APP has drawn my attention to the WhatsApp messages sent by the deceased to the first informant in respect of harassment to her. It is submitted that considering the nature of crime, the applicant may not be released on anticipatory bail.

I have perused the WhatsApp messages sent by the deceased to first first informant. Some of the WhatsApp messages reads thus :

i) “Dusri Shadi karke galti ki bhaiya main. Mera koi nai hai koi bhi nahi. Main thak gyi hu. Apko kisi se bhi ab kuch bhi baat karne ka jarurat nai hai. Mera kismat hi aisa hai.”

ii) “Ek baat bolu bhaiya Main itni bhuri/kharab hu kya? Ke girish ko mere sath galat karne main thoda bhi bura nai lgta.

8. Considering the above messages, at this stage it cannot

be said that afterthought allegations of harassment are made against the applicant. The deceased committed suicide within a

period of seven months of marriage. Considering the overall facts and circumstances, I am not inclined to release the applicant on anticipatory bail. The application is rejected.
