By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.81 of 2025 registered with the Samarth Police Station, Pune City, for the offences punishable under Sections 34, 406 and 420 of the Indian Penal Code, 1860.

The prosecution case is set out in Paragraph No.2 of the Order dated 11th February 2026 passed by the learned Additional Sessions Judge, Pune in Criminal Bail Application No.246 of 2026, which reads as under:

“2. Afore crime emerged from the report dated 23/04/2025 lodged by the informant Syed Hameed Shaikh alleging therein that he got acquainted with the applicant through one Farhana Patel. It is alleged that the applicant and her mother informed him that they are engaged in share trading, IPL speculation gambling, race-course and propagated that on investing in afore business, he would received crores of profit. It is alleged that on the representation of the applicant, the informant invested the amount of Rs.19.80 lacs. However, his investment did not yield any return. The informant persuaded the applicant for return. Accordingly, the applicant issued cheque of Rs.12 lacs with assurance of its encashment and Rs.6 lacs by cash. When he went to present the cheque with her banker, at that time, the applicant asked him to not to present the cheque and assured to return the amount by cash. Thereafter, from time to time, he persuaded the applicant to return the amount, but in vain. Eventually, he lodged the afore report.”

As per the prosecution case, the First Informant was persuaded to invest a total amount of Rs.19.80 Lakhs. Thereafter, the Applicant issued a Cheque of Rs.12 Lakhs and also assured payment of Rs.6 Lakhs in cash. However, thereafter, the Cheque was dishonoured and the cash was not paid.

On instructions, Mr. Kakade, learned Counsel for the Applicant, states that the Applicant is ready and willing to pay Rs.10,00,000/- to the First Informant. The Applicant will deposit the said amount before the Sessions Court. It is stated that Rs.2,00,000/- will be deposited within 2 weeks from today and the balance amount of Rs.8,00,000/- will be deposited within a period of 8 weeks thereafter.

Mr. Kakade, learned Counsel for the Applicant, submits that the said deposits are being made voluntarily by the Applicant. He further submits that the Applicant is pregnant and is likely to deliver the child shortly. He also submits that a Co-Accused has been granted anticipatory bail by this Court by Order dated 29th September 2025 passed in Criminal Anticipatory Bail Application No.2446 of 2025.

Accordingly, in the facts and circumstances, the case is made out for grant of anticipatory bail.

In view thereof, the following Order is passed:

(a) In the event of arrest of the Applicant - Pallavi Amol Gosavi, in connection with CR No.81 of 2025 registered with the Samarth Police Station, Pune City, she be released on bail on her furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station as and when called by the Investigating Officer till filing of the Charge-sheet and shall cooperate with the investigation.

(c) The Applicant shall abide by her voluntary statement as set out herein above in Paragraph No.5 of this Order.

(d) The Applicant shall furnish her cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

¶35
