Hemlata Sanjay Bobade and Anr. vs the State of Maharashtra Thr Pso Shegaon City, Dist Buldhana and Anr.

By the present Application, Applicants are seeking pre arrest bail in Crime No. 167/2026 registered with Police Station, Shegaon, District Buldhana for the offence punishable under Sections 75, 78, 333, 351(2), and 352 of Bhartiya Nyay Sanhita, 2023 read with Section 12 of the Protection Of Children from Sexual Offences Act, 2012 and Sections 3(1)(w)(i), 3(1)(w)(ii) and 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The prosecution case in brief is that, the Complainant Sau. Jyoti Ramdas Rathod, who is mother of the victim, lodged complaint to the Police Station against the present Applicants alleging that her daughter, who is taking education in 11^th standard at Mauli Junior College, Shegaon, was followed by the

son of Applicants and harassing her. It is alleged that on 14/3/2026 in the morning at about 8.00 a.m. victim told her that son of the Applicants namely, Rushikesh Bobade used to follow her and ask to talk with him and threatened for dire consequences to her and her younger brother, if she failed to do so. Thereafter at about 12.00 noon the Complainant made a call to the son of the Applicants and tried to give understanding but he did not pay heed, and on the contrary, at 2.00 p.m. in absence of the Complainant and her husband, both the Applicants came in front of the house of Complainant and created ruckus and abused on the caste as well as threatened to dire consequences. At that time victim and her sister were present in the house.

On the basis of aforesaid complaint, an offence came to be registered against the present Applicants at Police Station, Shegaon.

The Applicants came with a case that all the allegations levelled against them are false. According to them, there was a love relationship between their son Rushikesh and the victim, which was not approved by the parents of victim as well as Applicants. It is further contended that both the Applicants had been to the house of Complainant to have talk about love relationship between their son and the victim.

The learned Counsel for Applicants has specifically pointed out from the record that initially on 14/3/2026 the

Complainant approached to the Police Station, Shegaon to lodge complaint which was registered as NCR No. 133/2026. In the said complaint, the only allegations are made that the Applicants approached to the house of Complainant and created ruckus and threatened to dire consequences. As such, the Complainant, out of apprehension of life threats, lodged complaint to the Police Station. The said NCR No.133/2026 is annexed at Page 34 of the present Application.

Thereafter the complainant lodged report on 18/3/2026, in which, the Complainant made improvised allegations against the present Applicant that when the Applicants approached to her house, they abused her on caste and created ruckus in front of her house. As such on second complaint, offence came to be registered against the Applicants at Police Station, Shegaon.

It is further pertinent to note that this Court, vide order dated 10/4/2026 has granted interim protection and directed to co-operate the investigation. Undisputedly, the Applicants are co-operating in the investigation by attending the police station on the dates as mentioned in the order dated 10/4/2026. As such, looking to the conduct of the Applicants, they are entitled for pre-arrest bail in the matter.

In the light of this factual position, in my opinion, custody of both the Applicants is not necessary, and therefore, they

are entitled for protection till filing of the chargesheet in the matter. In the result, following order is passed.

ORDER

Criminal Application is allowed.

In the event of arrest in Crime No. 167/2026 registered with Police Station, Shegaon, District Buldhana for the offence punishable under Sections 75, 78, 333, 351(2), and 352 of Bhartiya Nyay Sanhita, 2023 read with Section 12 of the Protection Of Children from Sexual Offences Act, 2012 and Sections 3(1)(w)(i), 3(1)(w)(ii) and 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the Applicants – (i) Hemlata Sanjay Bobade; and (ii) Sanjay Ramnath Bobade be released on furnishing PR Bond in the sum of Rs. 25,000/- with one solvent surety each in the like amount.

The Applicants shall attend the Police Station, Shegaon on pre-intimation of the Investigation Officer as and when directed by the Investigation Officer till filing of the chargesheet and shall co-operate in the investigation.

The Investigation Officer is directed to give one day prior intimation to the Applicants as and when their presence is required.

The Applicants shall, at the time of execution of bond,

furnish their address and telephone/mobile number(s) to the Investigating Officer and the Court concerned, and shall not change the same till the final disposal of the case.

The Applicants shall not directly or indirectly make any inducement, threat or promise to any witness acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or any Police Officer.

The Applicants shall not obstruct or hamper the police investigation and not play mischief with the evidence collected or yet to be collected by the Police.

The Applicants shall maintain law and order.

¶34

In case of breach of any condition, the learned trial court is at liberty to cancel the bail after giving opportunity of hearing to both the sides.

The Criminal Application stands disposed of
