This is an Application for anticipatory bail.

The Applicant is apprehending his arrest in Crime No.265 of 2025 registered with Dombivali Police Station for the offences punishable under Sections 318(4), 316(2), 316(5), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3, 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999.

It is the case of the prosecution that the Applicant along with other co-accused had promised the first informant and other investors good returns on their investments and defrauded them to the tune of Rs.2,93,80,000/-.

Learned Counsel for the Applicant submits that the main allegations are against the co-accused Sandesh Joshi. It is submitted that the Applicant is also victim of the co-accused Sandesh Joshi. It is submitted

that the custodial interrogation of the Applicant is not necessary and the Applicant is ready and willing to cooperate in the investigation. Learned Counsel for the Applicant, on instructions, submits that the Applicant, without prejudice to his rights and contentions, is ready and willing to deposit an amount of Rs.30,00,000/- within a period of six weeks. It is submitted that there are no other criminal antecedents against the Applicant.

On the other hand, Learned APP for the Respondent-State and Learned Counsel for Respondent No.2-first informant submit that the Applicant has induced the investors to invest money through co-accused Sandesh Joshi. It is submitted that the present Applicant and other coaccused have defrauded the investors to the tune of Rs.2,93,80,000/-. It is submitted that the present Applicant is the beneficiary of defrauded amount. It is thus submitted that the Applicant may not be released on anticipatory bail.

I have perused the material on record. The main allegations are against the co-accused Sandesh Joshi. Considering the overall facts and circumstances and as the Applicant is ready to deposit an amount of Rs.30,00,000/-, I am inclined to release him on anticipatory bail. Hence, the following order:-

i. The Anticipatory Bail Application is allowed.

ii. In the event of the arrest of the Applicant in Crime No.265 of 2025 registered with Dombivali Police Station for the offences punishable under Sections 318(4), 316(2), 316(5), 3(5) of the

Bharatiya Nyaya Sanhita, 2023 and Sections 3, 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999, he shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

iii. The Applicant shall attend the concerned Police Station as and when called for by the investigating officer and shall cooperate in the further investigation, if any.

iv. The Applicant shall deposit an amount of Rs.30,00,000/- with the Special Court within a period of six weeks.

v. Liberty is granted to the investors to file an application before the special/trial court for withdrawal of the said amount. If such application is filed, the special/trial court shall decide the same on its own merits.

The Anticipatory Bail Application is disposed of in the aforesaid terms.
