Writ Petition No. 9514 of 2025, High Court of Judicature at Bombay (Civil Appellate Jurisdiction), decided 14 August 2025 by Madhav J. Jamdar, J. The petitioner, Mrs. Anita Ashok Kadam alias Anita Ankit Chaudhary, biological mother of the minor child Abir (aged 9), challenged the order dated 26 May 2025 of the learned 3rd Family Court, Mumbai, in Petition No. D-32 of 2025 granting her limited access to the child. The child has been in the custody of the Parties of the Second Part, namely his grandmother Mrs. Tulsa Ashok Kadam (mother of the petitioner, Respondent No. 1) and his uncle Mr. Abhijeet Kadam (brother of the petitioner, Respondent No. 2), since 30 December 2024, when he was voluntarily placed with them; the petitioner had instituted Case No. D-32 of 2025 before the Family Court at Bandra seeking restoration of custody and, as ad-interim relief, regular access. In court, both sides tendered Consent Terms executed at Mumbai on 14 August 2025, signed by the petitioner (personally present) and Respondent Nos. 1 and 2 (Respondent No. 2 personally present), with signatures identified by their respective advocates; the terms were taken on record and marked 'X'. Access regime agreed: (a) in-person access every Sunday 5.00-7.00 p.m. at Raghuleela Mall, Kandivali, Mumbai; fifth-Sunday access at Raghuleela Mega Mall, Kandivali (West); Respondent No. 2 to drop and receive the child; a mobile phone for the child for communication purposes only; and an option, by mutual consent upon culmination of monsoon 2025, of alternate Sundays at a children's park/garden near the respondents' residence; (b) access every working Saturday 3.30-5.00 p.m. at the Child Complex, Family Court, Bandra, per the 26.05.2025 ad-interim order; (c) Sunday access gradually increased to three, four and five hours depending on the child's comfort, well-being and interest; (d) daily WhatsApp video calls of 15-30 minutes between 9.00 and 9.30 p.m.; (e) neither the respondents nor the child's stepfather present during in-person access and video calls; (f) one hour (9.00-10.00 p.m.) of video supervision of examination preparation on the day preceding each exam; (g) mutual undertaking not to influence, prejudice or tutor the child against each other; (h) academic updates to the mother by SMS/WhatsApp/phone, prior intimation before school visits, shared school-portal credentials not to be changed without mutual consent, and joint attendance at school meetings, functions and events; (i) the mother not to discuss the stepfather with the child; (j) Respondent No. 2 to maintain physical distance and not remain on the same floor during access, and Respondent No. 1 not to attend or interfere. Disposition: the Writ Petition stands disposed of in terms of the Consent Terms; the terms are expressly ad-interim and purely temporary and remain in force until the Hon'ble Family Court at Bandra passes an interim order on the pending interim application and/or a final order in Case No. D-32 of 2025. No provision of any statute and no precedent case is cited; the disposal rests wholly on the recorded consent of the parties.
