Case brief
What is this about?
Temporary injunction refusal; Order XXXIX Rules 1 and 2 CPC; specific performance of agreement to sell dated 11.10.2021; cancellation by public notice in Nav Bharat; refund of earnest money Rs.25,00,000/-; net payment Rs.10,000/-; subsequent purchasers constructing at plinth level; prima-facie case; balance of convenience; irreparable loss; conduct of parties; perversity review under article 227; Nagpur Improvement Trust regularization; Special Suit 172/2022; Misc. Civil Appeals 157/2023 and 206/2025; Trinetra Real Estate Builders & Developers; Nagpur Bench; 2025:BHC-NAG:13762.
What did the court decide?
No prima-facie case: defendant nos.2 and 3 purchased the suit property after the plaintiff's earlier injunction application (Exhibit 5) was rejected, and having purchased it are entitled to construct; the plaintiff, whose earnest of Rs.25,00,000/- was refunded and who retains only Rs.10,000/- paid against the agreed consideration of Rs.2,20,00,000/-, has no prima-facie right to restrain construction or alienation. Its prima-facie case exists only to the limited extent of putting subsequent purchasers on notice of the pending suit, and the appellate Court's observation to that effect is sound.
