The State of Maharashtra & Ors.), filed from 2018 onward by serving/retired teaching and non-teaching staff of a large Respondent-Educational Institution (Respondent-STES) over non-payment of monthly salaries, arrears, gratuity, provident fund, leave encashment and retirement dues. HOLDING: every aspect (pay scales, salary structuring, monthly salaries, strike-related recoveries, gratuity) is seriously disputed between Petitioners and Management; continuous adjudication/monitoring of such disputed issues would be beyond the Court's jurisdiction, and statutory authorities having superintendence (Government pays salary and non-salary grants) should instead resolve them. DIRECTIONS: (i) Joint Director, Technical Education, Pune - Engineering/Polytechnic and Pharmacy/Architecture etc. college employees; (ii) Divisional Deputy Director, Education, Pune - Employees/Management of schools from 1st to 12th Standard including CBSC schools; (iii) Deputy Director, Higher Education - Commerce College grievance. Mechanism: Authorities to scrutinize month-to-month payment strictly per applicable Pay Commission recommendations; employees to tender individual calculations (copy to Authorities) preferably in 30 days; Management to verify and re-calculate per applicable pay-scales within 60 days and tender copies within 10 days; undisputed amounts released within a further 60 days; disputed amounts concluded within 120 days (AGP's request); scale-applicability disputes (higher qualifications) decided by the Authorities with SC/HC pronouncements in view, hearings via Legal Representatives capped at 5 hours per side; reasoned order within a further 30 days; any additional amounts payable within 30 days of the order; defaults attract interest @ 4% p.a., while gratuity carries statutory interest @ 10% p.a. from 30 days after severance of employer-employee relationship; aggrieved parties may assail the authority's final order via statutory remedy.
