After several rounds of hearing, Petitioner Management and Respondent No.4 — widow of a part-time teacher who died in harness on 15-10-2020 — jointly tendered minutes of order dated 27-03-2025, taken on record as X-1 and approved by the Court: (i) impugned order dated 05-08-2024 quashed and set aside; (ii) Respondent No.5 (teaching employee since 01-08-2010, earlier C.H.B., later part-time) stands appointed full-time Assistant Teacher (Marathi) w.e.f. 01-07-2024 against the post vacated by V.D Shelke's superannuation on 31-05-2024, Respondent No.4 undertaking not to dispute that appointment; (iii) Respondent No.4's appointment order to issue on 01-04-2025 with same-day joining per the Court's direction (¶38(a)) — note the printed minutes item 5 instead reads that the part-time post w.e.f. 01-04-2025 will go to 'Respondent No.5'; (iv) Respondent No.4 to be appointed full-time Shikshan Sevak w.e.f. 01-02-2026 in the Secondary School on the post of Dattatraya Tukaram Kamble (D.Ed. scale w.e.f. 11-06-1990), who retires on superannuation on 31-01-2026, appointment order one week before joining; (v) approval machinery fixed: proposals for part-time approvals of Respondent Nos. 4 and 5 within 15 days; Deputy Director of Education (R-2) to approve R-4's compassionate appointment within 15 days; Education Officer (Secondary) (R-3) to approve R-4's 2026 appointment subject to TET; R-5's proposal to be decided on merits by reasoned order within 30 days, deficiencies to be cited in one stroke without rejecting the proposal; (vi) R-4 to pass TET/CTET within three consecutive attempts or three years per Government Resolution dated 02-09-2024, whichever is later.
