Writ Petition (Article 226, Constitution of India) filed on 10 April 2023 by Mohammad Shahid Ramzan Khan against the Slum Rehabilitation Authority (through CEO) and others, including Respondent No.5 developer, concerning Daulatnagar (Daulat Nagar) SRA CHS Ltd. (Navjeevan Nagar), CTS No. 1611 (pt), T.P.S. VI, Daulat Nagar, Santacruz (W), Mumbai. Prayers sought mandamus directions that the developer pay arrears and future rent with 5% yearly rise and monthly transit rent since demolition of the Petitioner's hutment relating to year 1999, as per the Assistant Registrar, Co-operative Societies (East and W/N), SRA order dated 30.12.2022 (Exhibit P); allot a commercial rehab structure, the Petitioner being eligible at Sr. No. 15 (68) in Annexure-II; register the agreement with the Petitioner in tune with SRA Circular No. 153 dated 06.06.2015; and issue a stop work order against the developer in pursuance of the Assistant Registrar's order dated 27.03.2023 (Exhibit - R). The SRA's reply affidavit recorded the developer's letters dated 12.04.2023 and 17.04.2023 (structure at Sr.No.68, Annexure-II not demolished; no transit rent payable), a Field Officer's spot inspection report dated 08.03.2023 (EXHIBIT-R/1) confirming the undemolished structure in business use, the Assistant Registrar's letter dated 27.03.2023 (EXHIBIT-R/2) asking the Engineering Department not to act on the stop work notice for the free sale component, and its letter dated 31.10.2023 (EXHIBIT-R/3) informing the Petitioner no rent was payable; commercial permanent alternate accommodation was promised as and when the rehab building is constructed. Noting the passage of almost two years since filing, the Court (G. S. Kulkarni and Aarti Sathe, JJ.) was not inclined to consider the prayers in view of the affidavit and the 31.10.2023 communication, and disposed of the Petition keeping open all contentions of the Petitioner to be raised before the SRA in appropriate proceedings, including any challenge to the 31.10.2023 communication. No costs.
