PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of Certified copy of last Will and Testament of deceased filed by petitioner namely Shrikant Satyanarayan Agarwal being sole Executor named under the Will of deceased. The deceased namely Satyanarain Gulabrai Agarwal died at Mumbai on 03.02.2019. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

The deceased left behind his last Will and Testament which was duly executed at Mumbai on 25.11.2013. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Two daughters of deceased namely Krishnadevi and Kirandevi have expired and their legal heirs mentioned in para No. 8 of the petition. Deceased was survived by two sons, two daughters, four grandsons and three granddaughters. Out of them one son is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

Petitioner's oath is filed. Affidavit of Abhishek Tibrewala and Devkishan Jhariwala dated 27.07.2022 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 01.04.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

Office to issue LIMITED Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
