Transfer of matrimonial proceedings — wife-applicant Seema Nahid, a teacher residing at Akola with her three minor daughters (aged about 7 and twin 4-year-olds), sought transfer of Petition No.208/2024 filed by her husband, the non-applicant Mohammad Shoeb (a Bank of Baroda employee at Amravati), from the Family Court, Amravati to the Family Court, Akola, on the ground that she has three minor children and no family member available to look after them if she travels to Amravati. On notice, the non-applicant appeared and raised no objection to the transfer; he only sought permission to attend the proceedings before the Family Court, Akola through video conferencing, undertaking to secure his physical presence as and when required, and prayed for early disposal. Accepting this consensus position, Pravin S. By this application, the applicants are seeking the transfer of the proceedings filed by the non-applicant before the Family Court, Amravati to Family Court, Akola.

In light of the grounds raised by the applicants that she is having three minor children and there is no one in her family to look after them to Akola, this Court has issued notices to the nonapplicant in the matter.

The non-applicant in response to the notices of this Court appeared in the matter. On appearance, learned Counsel Shri Faizan Ismail Khan, appeared, on instructions, stated that he has no

objection for transfer of the petition No.208/2024 pending on the file on Family Court, Amravati to Family Court, Akola.

It is only submission of non-applicant that he may be permitted to attend the proceedings before the Family Court, Akola, through video conferencing and he undertakes to secure his physical presence as and when required before the Family Court, Akola. He further stated that the pending proceedings should be decided at the earliest.

In light of the submission made by the non-applicant in

the matter, in my opinion, the present application can be disposed of by passing the following order:

ORDER

i) The application is allowed.

ii) The transfer application No.208/2024 is here by transfer from Family Court, Amravati to Family Court, Akola.

iii) Family Court, Amravati is directed to transfer the record and proceedings of the Petition No.208/2024 to the Family Court Akola. iv) The Family Court, Akola, is directed to permit the nonapplicant through video conferencing to attend the proceedings and
