By this transfer petition, the applicant, husband of the respondent is seeking transfer of two proceedings, viz., marriage petition filed by the applicant-husband which was transferred from Pune Family Court to Udgir, Latur Civil Judge Senior Division and the DV proceeding filed by the respondent-wife before the Judicial Magistrate First Class at Udgir, Latur, both the proceedings to be transferred to the Family Court at Pune.

It is the case of the applicant-husband that by an order dated 17 April, 2025 passed in Miscellaneous Civil Application filed by the respondent-wife, the marriage petition was transferred from the Family Court, Pune to the Civil Judge Senior Division, Udgir, Latur.

The grounds on which the transfer has been sought is that the respondent-wife from February 2025 has shifted her job to M/s.Testsigma, having its office at Bangalore, Karnataka. Therefore, without disclosing this fact, on 17 April, 2025, the respondent-wife has got the marriage petition transferred from Pune to Udgir, Latur.

It is submitted before me that by hiding the fact that the respondent is working at Bangalore, the proceedings got transferred from Pune Family Court to Civil Judge Senior Division, Udgir. It is submitted that it is not even convenient to the respondent-wife to transfer the proceeding to Udgir, Latur as she is working at Bangalore. However, it will become inconvenient to the present applicant to travel 450 kms from Pune to Udgir, Latur to attend the court proceedings.

It is further submitted that if the proceedings are retransferred to the Family Court at Pune, the applicant will have no objection if the respondent is attending the court proceeding through Video conferencing.

An affidavit dated 12 November, 2025 has been tendered before me that in order to prove that the respondent has been served at her Bangalore address. The said affidavit of service at page 11 and at page 13 shows the tracking report of the Indian Post where it can

be seen that the respondent has refused to accept the service on 10 November, 2025. It has been also stated that a soft copy of the proceeding has been served by e-mail to the respondent.

As a matter of last chance to allow the respondent to attend the court proceedings, the applicant is directed to once again serve the respondent at her address by all permissible modes of service before the next date of the hearing and file affidavit of service to that effect.
