All these applications have been filed by the applicant – wife of the respondent – husband seeking transfer of Domestic Violence proceedings filed by her before the Civil Judge Junior Division, Kopargaon, Ahilyanagar to the Metropolitan Magistrate Court, Bandra, Mumbai, the Divorce Petition filed by the respondenthusband before the Civil Judge Senior Division, Kalyan, Thane to the Family Court, Bandra, Mumbai and the proceedings under Section 125 of the Code of Criminal Procedure filed by the applicant-wife before the Civil Judge Senior Division, Kopargaon, Ahilyanagar to the Family Court, Bandra, Mumbai.

2. After the matter was argued for some time, both learned counsel fairly, on instructions of their respective clients agreed to dispose of all the applications. Hence, the Misc. Civil Applications stand allowed with following directions:

(i) PWDVA/49 of 2023 pending before the Civil Judge Senior Division, Kopargaon, Ahilyanagar, is transferred to the Family Court at Bandra, Mumbai. The proceedings be transferred within a period of four weeks from today.

(ii) Marriage Petition No. 1002 of 2023 filed by the respondenthusband, pending before the Joint Civil Judge Senior Division, Kalyan, Thane is transferred to the Family Court at Bandra, Mumbai. The proceedings be transferred within a period of four weeks from today.

(iii) Criminal M. A. No. 296 of 2023 pending before the Civil Judge, Junior Division, Kopargaon, Ahilyanagar, is transferred to the Family Court, Bandra, Mumbai. The proceedings be transferred within a period of four weeks from today.

(iv) All the proceedings viz. PWDVA/49 of 2023, Marriage Petition No. 1002 of 2023 and Criminal M. A. No. 296 of 2023, be clubbed and heard together by one Judge at Family Court, Bandra, Mumbai.

3. As the respondent-husband has shown his willingness to voluntarily pay the school fees of the daughter ‘Swarangi’, he is permitted to pay the school fees of the daughter ‘Swarangi’ directly to the school authorities and the copy of the receipt be furnished to the applicant-wife.

So also, it is on instructions of the parties both the lawyers have agreed that the respondent-husband is allowed to meet his daughter along with his parents on last Saturday of every month, starting from October 2025 in the afternoon, between 2.00 p.m. to 7.00 p.m., at Phoenix Palladium, situated at Lower Parel, Mumbai.

5. The applicant – wife would take all necessary steps to facilitate such meeting of the respondent – husband along with his parents with their daughter ‘Swarangi’ and she will not interfere during such meeting time. It would be on last Saturday of every month, till any further orders are passed as regards to access of the daughter ‘Swarangi’ to the respondent – husband by the Family Court.
