This matter was heard and in the midst of the argument, certain query was raised by the Court. To enable the learned advocate for the applicants to address the query the matter was adjourned today.

Today, the learned counsel for the respondents in the application states that this matter has suddenly come up on board and no notice was given to them. Furthermore, some of the counsel for the respondents states that no notice of the praecipes being moved for the matter being listed was given to them.

In my view, this is a wrong and false statement made across the bar. This matter was heard, and on a query being raised by the Court, the matter was adjourned. Therefore, to say that the matter has suddenly come up on board and further to say that this matter has come up because the praecipes was moved and which was not marked to the respondents is incorrect.

Such a type of practice is deplorable. Without knowing the facts of the matter as to whether it was argued or not to make such submissions is not correct.
