The Defendant is a partnership firm of Nileshbhai Babubhai Patel, Gitaben Nilehbhai Patel, Pulkeshi Bavanjibhai Gami, Sonalben Pulkeshi Gami, Subhashchandra Mansukhlal Makwana, Shitalben Subhashchandra Makwana, Tushar Vallabhbhai Rajpara and Tejal Tushar Rajpara.

The Plaintiff abovenamed has filed the present suit against the abovenamed Defendant praying inter alia for reliefs relating to infringement of its registered trade mark ROYALE and for passing off the goods viz. emulsion, paints or other like goods used in the paint industry by the Defendant, by use of the impugned mark ROYAL/SAFF ROYAL and for other reliefs, as more particularly mentioned in the Plaint.

5 The Defendant accordingly submits to a Decree in favour of the Plaintiff in terms of prayers (a), (b) and (c) of the Plaint, which reads as under :-

b. the Defendant by themselves, their proprietor/partners, servants, agents, assignees, stockists, distributors and all those connected with the Defendant in their business be restrained by a perpetual order and injunction of this Hon'ble Court from manufacturing, marketing, distributing, selling and/or using in any manner whatsoever in relation to their emulsion, paints or other like goods used in the paint industry, the impugned mark ROYAL/SAFF ROYAL emulsion and from using any mark identical with and/or deceptively similar to the Plaintiff's distinctive, prior used and well known trade mark ROYALE, so as to pass off the Defendant's goods and business as and for those of the Plaintiff or in some way connected or associated therewith;

c. the Defendant be ordered and decreed to deliver-up to the Plaintiff for destruction all such materials including emulsion, paints and other like goods used in the paint industry, product packaging, containers, buckets, labels, stickers, advertising and packaging materials, dyes, screens, blocks, moulds, papers, vouchers, bill books, carry bags, and other goods bearing the impugned deceptively similar mark ROYAL/SAFF ROYAL emulsion as complained off;

& During the execution of the Court’s commission, the Additional Special Receiver came across an additional impugned mark ROYAL-EXCEL premium emulsion being deceptively similar to the Plaintiff s trade mark ROYALE at the Defendant’s premises. A copy of the inventory of the impugned additional product seized from the premises of the Defendant by the Additional Special Receiver (and mentioned in the Court Receiver’s Report No. 340 of 2024 dated 19.07.2024 at Page No. 29) making reference to the impugned additional mark ROYAL

EXCEL premium emulsion and colour photographs showing the Defendant’s impugned product bearing the impugned additional mark are appended hereto at ANNEXURE A. The Defendant hereby further agrees and undertakes ‘that he shall also not hereafter use the additional impugned mark ROYAL EXCEL premium emulsion nor use any mark deceptively similar to the Plaintiff's trade mark ROYALE as aforementioned.

7, As regards prayer clause (c) above, the Defendant undertakes to deface the goods bearing the impugned mark ROYAL/SAFF ROYAL paints as seized and sealed by the Court Receiver at the Defendant’s premises. The Defendant also undertakes to deface the goods bearing the additional impugned mark ROYAL EXCEL premium emulsion as mentioned in para é hereinabove. The unbranded pouches and/or containers alongwith the contents thereof would then be duly returned to the Defendant for future use under a different trade mark. The Defendant further agrees to destroy all such materials including shade cards, poly bags, pouches, containers, labels, stickers, advertising and packaging materials, dyes, screens, blocks, moulds, papers, vouchers, bill books, carry bags bearing the impugned mark ROYAL/SAFF ROYAL and bearing the additional impugned mark ROYAL EXCEL premium emulsion. The aforesaid destruction and defacement is agreed by the parties to be undertaken in the presence of the Plaintiff's representative

3 As regards the Plaintiffs claim of damages mentioned in prayer clause (d) of the Plaint, the Defendant hereby pays an amount of Rs. 1,25,000/- (Rupees One Lakh twenty Five Thousand Only) in favour of the Plaintiff, i.e. Asian Paints Lintited, vide Demand Draft No. OSS 22 dated \q | 12/ Joly undertakes to this Hon’ble Court that the said Demand Draft issued in the Plaintiff's favour will be honored by their bankers.
