Civil Application (CAF) No. 3765 of 2024 in First Appeal No. 808 of 2018 (D); High Court of Judicature at Bombay, Nagpur Bench (Pravin S. Patil, J.), decided September 19, 2025. The Appellant, The Oriental Insurance Company Ltd., had deposited an amount in this Court in the pending First Appeal, and the present Civil Application sought its withdrawal. By order dated 14/1/2025 the Court had directed the Respondents/Claimants to place on record their bank account numbers and an affidavit recording that Respondent No.2 had died leaving behind no legal heirs. In compliance, the Respondents filed an affidavit dated 3/2/2025 stating that Respondent No.2, who expired on 27/4/2022, left behind no legal heirs, and placed on record the bank passport and other details as directed. Holding that, in view of the statement made on the affidavit, there was no impediment to allowing the Application, the Court allowed the Civil Application and permitted Respondent Nos.1 to 5 to withdraw the amount lying with the Registry along with the interest accrued thereon, subject to satisfaction of the Registrar (Judicial).
