Bail refused — Bombay High Court (Criminal Appellate Jurisdiction), Ashwin D. Bhobe, J.: Bail Application No.4979 of 2024 under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by Allauddin Mahbubsab Babarchi (Accused No.4 of four accused) seeking bail in C.R. No.66 of 2024 (Kavathe Mahakal Police Station, Sangli) for offences punishable under Sections 302, 201, 109 and 120(b) read with 34 of the Indian Penal Code, 1860; crime committed as Sessions Case No.100 of 2024 pending before Additional Sessions Judge-3, Sangli. Prosecution version: Accused No.1's relationship with the deceased's wife as motive; conspiracy to eliminate the deceased; the deceased was taken in a car driven by the Applicant, stabbed to death on the rear seat by Accused Nos.2 and 3 with a knife, and his body was burned with diesel and disposed of in a secluded place. Applicant arrested 16.02.2024 and in custody since; his earlier bail application (Exhibit-8, along with Accused No.2) was dismissed on 05.10.2024 by Additional Sessions Judge-3, Sangli. Defence contention: Applicant's role confined to driving the car and assisting in pouring diesel/burning/disposal — at most an offence under Section 201 IPC; extra-judicial confession of Accused No.1 to his uncle a weak piece of evidence. Prosecution contention: well-planned murder with common intention; deceased's wife categorically named the accused; extra-judicial confessions of Accused No.2 to three persons; CCTV footage and CDR records place the Applicant in the area. Court found: charge-sheet discloses the motive and intention of the Applicant and co-accused; CCTV footage and CDR reveal the Applicant's presence with the deceased during the incident; he was in the car when the murder was committed and, as driver, actively participated in destruction of the body and evidence, supporting the prosecution case; prima facie clinching material about his complicity; allegations serious and heinous in nature. HELD: not a fit case for grant of bail — application dismissed; observations confined to the bail application and not to affect the merits at the trial stage.
