Bombay High Court (Milind N. Jadhav, J.), Criminal Bail Applications Nos. 4955 and 5152 of 2024, decided 25 February 2025 — Regular bail under Section 439 of the Code of Criminal Procedure, 1973 granted to Anil O. Khandelwal (Chief Financial Officer of Cox and Kings Ltd ('CKL')) and Naresh Tikamchand Jain (proprietor of N.T. Jain and Company, Internal Auditor of CKL), co-accused in C.R. No.30 of 2020 registered by Economic Offences Wing (EOW), Banking Unit-II, Mumbai, on the complaint of Kotak Mahindra Bank alleging default/non-repayment of Rs. 174.32 crores working-capital loan advanced between November 2012 and August 2019; offences under Sections 406, 409, 465, 467, 468, 471, 477A readwith 120-B IPC; charge-sheet filed 26.03.2021. Bail allowed on parity — the principal accused Ajay Ajit Peter Kerkar having been enlarged by the Supreme Court on 29.08.2024, and the Applicants having been granted bail by this Court by orders dated 13.08.2024 and 28.11.2024 in other matters and by the PMLA Special Court on 30.04.2024 — coupled with long incarceration (approximately 4 years 1 month 28 days and 3 years 11 months 8 days respectively) and completed investigation. Amounts allegedly received by the Internal Auditor held prima facie to be professional charges/fees (taxes paid), receipt whereof cannot by itself defeat bail; allegations of routing monies to bogus/fictitious companies left for trial. Following Javed Gulam Nabi Vs. State of Maharashtra, 2024 SCC OnLine SC 1693 (with Union of India Vs. K. A. Najeeb, (2021) 3 SCC 713 and Satender Kumar Antil Vs. CBI, (2022) 10 SCC 51), the Court held that the position permitting enlargement of substantially incarcerated under-trials, speedy trial being a facet of Article 21, enured to the Applicants' benefit. The Court also observed, prima facie and solely for the bail purpose, that banks advancing large public money on the strength of balance sheets must perform enhanced due diligence over the loan tenure. Release ordered on P.R. bond of Rs. 1,00,000/- each with one or two like sureties, with provisional cash bail of Rs. 1,00,000/-, subject to conditions (reporting to EOW IO, trial attendance, no travel outside Maharashtra without permission, passport surrender within 2 weeks, no witness influence/tampering); all observations confined to the bail purpose, trial to proceed uninfluenced.
