Bombay High Court (R.N. Laddha, J.), 9 June 2025 — Criminal Anticipatory Bail Application No. 933 of 2025, Ravi Prakash Rajpati v. The State of Maharashtra: Interim order. Applicant's counsel submitted that during the relevant period the applicant was gainfully employed in the banking sector (Axis Bank, 10 February 2023 to 8 September 2023, as tele-caller contacting prospective clients for loan services; IndusInd Bank, 18 September 2023 to 4 April 2024, opening current accounts; Kotak Bank, April 2024 to July 2024), had no connection with the alleged offence, no association with the mobile number allegedly used, was never in contact with the co-accused, and received no benefit from the alleged transactions; it was further contended that the complaint was lodged after an unexplained delay of 11 days. As the Investigating Officer was absent, the learned APP sought time and assured the Court that the applicant would not be arrested in connection with the present crime until the next date, subject to the applicant reporting to the concerned police station. . The learned Counsel for the applicant submits that the applicant has been gainfully employed in the banking sector during the relevant period and has no connection with the alleged offence. It is submitted that the applicant worked in the Axis Bank from 10 February 2023 to 8 September 2023, where his role was limited to that of a tele-caller, responsible for contacting prospective clients and pursuading them to avail of loan services offered by the Bank. Thereafter, the applicant joined the IndusInd Bank from 18 September 2023 to 4 April 2024, wherein his duties were confined to opening current accounts for customers in accordance with the Bank’s operational guidelines. employed with Kotak Bank from April 2024 to July 2024.

The learned Counsel further submits that there has been a delay of 11 days in lodging the complaint, and the informant has failed to offer any explanation for such delay. It is also submitted that the applicant has no association whatsoever with the mobile number alleged to have been used in the commission of the offence. He was never in contact with any of the coaccused and is not a recipient or beneficiary of any amount connected to the alleged transactions.

The learned APP seeks time to obtain further instructions, as the Investigating Officer is not present. However, he assures the Court that the applicant will not be arrested in connection with the present crime untill the next date subject to condition that the applicant reports to the concerned police station. Accordingly, the applicant is directed to attend the concerned police station on 11^th , 12^th and 13^th June 2025, between 2.00 p.m. and 5.00 p.m., and to cooperate with the investigation.
