This is an Application for anticipatory bail.

The Applicants are apprehending their arrest in Crime No.748 of 2024 registered with Borivali Police Station for the offences punishable under Sections 75, 79 and 85 of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that in 2024, the first informant got married to the Applicant No.1. It is alleged that after their marriage, the Applicant No.1 subjected the first informant to physical and mental cruelty. The allegations against the Applicant No.2 are of abetting the Applicant No.1.

I have heard Learned Counsel for the Applicants, Learned APP for Respondent No.1-State and Learned Counsel for Respondent No.2-first informant.

Learned Counsel for the Applicants submits that the false allegations are made against the Applicants. It is submitted that the prosecution has already filed chargesheet and thus there is no need of custodial interrogation.

On the other hand, Learned APP for Respondent No.1-State and Learned Counsel for Respondent No.2-first informant submit that considering the nature of crime, the Applicants may not be released on anticipatory bail.

The prosecution has already filed chargesheet against the Applicants. Thus there is no need of custodial interrogation. Considering the overall facts and circumstances, I am inclined to release the Applicants on anticipatory bail. Hence, the following order:

i. The Anticipatory Bail Application is allowed.

ii. In the event of the arrest of the Applicants in Crime No.748 of 2024 registered with Borivali for the offences punishable under Sections 75, 79 and 85 of the Bharatiya Nyaya Sanhita, 2023, they shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with one or two sureties in the like amount.

The present Anticipatory Bail Application is disposed of in the aforesaid terms.
