Bombay High Court, Aurangabad Bench (Arun R. Pedneker, J.), 13 January 2025 — Nine connected anticipatory bail applications (Nos. 265, 183, 206, 238, 260, 292, 312, 313 and 335 of 2024) along with Criminal Application No. 1289 of 2024 in ABA/273/2024 (Triveni Kharjule). By order dated 28.03.2024 in ABA/273/2024 the Court had rejected Triveni Kharjule's anticipatory bail as she was President of the credit society at the relevant time, while granting interim protection to the present applicants and distinguishing their case from that of the Kharjule family. Counsel for the applicants submitted that the entire credit society was controlled by the Kharjule family (President, Vice-President, Secretary and two Directors belonging to one family), that allegedly fabricated loans were given to their own family members, that other Directors though on record were not functioning and are not beneficiaries, and (in ABA/265/2024) that the applicant was not a Director at the relevant time. The Court directed the learned APP to provide details of beneficiaries of the loan transactions and to state on the next date whether any Director, their family members or relatives benefited, and to furnish details of any non-cooperation by the applicants in investigation. Matters stood over to 20.01.2025; interim relief, if any, to continue; applicants to cooperate with investigation meanwhile.
