records of the Petitioner’s case and after perusing the same, direct Respondent Nos.1 to 4 to forthwith return the original Deed dated 30^th March, 1994 to the Petitioner.

(b) that this Hon’ble Court be pleased to issue a writ of mandamus or a writ in the nature of mandamus or any other appropriate writ, order or direction calling for the records of the Petitioner’s case and after perusing the same, and in the event Respondent Nos.1 to 4 are unable to locate the original Deed dated 30^th March, 1994, then Respondent Nos.1 to 4 be directed to do the following:

i. Respondent Nos.1 to 4 to acknowledge that the Deed dated 30^th March, 1994 (Exhibit C hereto) has been executed and registered by the Joint Lessees/Owners;

Respondent Nos.1 to 4 to permit the Petitioner to execute and register a Declaration (stamped with Rs.100/-) inter alia declaring the execution and registration of the Deed dated 30^th March, 1994 and that he is the sole and absolute lessee/owner of the Premises in the format (Exhibit C hereto)

iii. Do all such acts, deeds, matters and things including issuing letters, declaration so as to rectify the loss of Deed dated 30^th March, 1994”

By and under a Deed dated 30^th March 1994 (Regn No.BBE1-1287 of 1994) made and executed by and between one late Amritlal Bhavanbhai Kotak (“ Amritlal ”), late Lilavanti Amritlal Kotak (“ Lilavanti ”), the Petitioner and the late Urmi Sudhir Kotak (“ Urmi ”); Amritlal and Lilavanti in consideration of natural love and affection conveyed, transferred, assigned and assured unto the Petitioner and Urmi an undivided one fourth share each of the immovable property

being piece or parcel of land admeasuring 757 sq. yds., equivalent to 632.95 sq. mtrs., bearing Plot No.119 of the Gamdevi Estate and also bearing Cadastral Survey No.500 (Malabar and Cumballa Hill Division), Mumbai and being Municipal D-Ward No.2893 (2) and Laburnum Road, Street No.20, Gamdevi, Mumbai-400007 within the Island City of Bombay within the Registration District of Bombay, with building thereon known as “Puri Villa” consisting of ground plus two upper floors along with garages and outhouses (“ Premises ”), as joint tenants, and on the terms and conditions as more particularly mentioned therein. The said Original Deed dated 30^th March, 1994 was lodged and registered by the parties thereto before the Respondents under Regn. No.BBE-1-1287 of 1994.

3. The Respondents have averred that Respondent No.3 appears to have misplaced the Original Deed dated 30^th March, 1994 and the same has till date not been returned to the Petitioner by the Respondents.

4. The Petitioner has averred in the above Writ Petition that late Amritlal, late Lilavanti and late Urmi have expired and now he is the sole and absolute owner/lessee of the premises.

Mr.Behramkamdin, the learned senior counsel appearing on behalf of the Petitioner, has also tendered a declaration-cumindemnity (without annexures), which is proposed to be executed and registered with the registering authorities. This declaration-cumindemnity has been seen by the officers of the Sub Registrars Office, and no objection to the same has been raised.

In these peculiar circumstances and since the original registered deed dated 30^th March 1994 cannot be traced in the office of the Respondents, we direct that the Petitioner shall execute and register the declaration-cum-indemnity (to be stamped with Rs.800/-), inter alia, declaring the execution and registration of the Deed dated 30^th March 1994 in the format as per the declaration-cum-indemnity (without annexures) handed over to the Court today, and which is taken on record and marked ‘ X ’ for identification. For the sake of convenience, a copy of this declaration-cum-indemnity (without annexures) is appended to this order. The Respondents shall accept the said declaration-cum-indemnity (with the annexures referred to therein) and register the same.

7. We may hasten to add that this order is passed in the peculiar and special circumstances of this case and shall not be used as precedent in any future matters.
