In so far as the disqualification of the petitioner vis-a-vis the present respondent No.1- Western Coal Field Limited is concerned, the respondent No.1, in its submissions dated 02.07.2024, has made a statement that since the period of black listing is over, the same would not be considered as an impediment for the petitioner for future participation in any tender process vis-a-vis respondent No.1. This should take care of the grievance of the petitioner vis-a-vis respondent No.1.

Mr. Samudra, learned Counsel for respondent No.1, on instructions, makes a statement that the order of black listing would not operate as a stigma/disqualification for the petitioner to participate in the future tenders, provided the petitioner complies with the requirement of the NIT and the Rules and Regulations governing the same.

Mr Manohar, learned Senior Counsel for the petitioner submits that this satisfies the grievance of the petitioner, in view of which, petition is disposed of in terms of the aforesaid statement.
