3. All contentions of the parties in the pending proceedings are expressly kept open.
4. Needless to observe that if the petitioner files any application for amendment in the suit, the same be decided by the Civil Court in accordance with law.

6. In view of disposal of the writ petition, pending Interim Application would not survive, it is accordingly disposed of.
