Issue notice for final disposal to the respondents, returnable on 10/07/2024 .

The petitioner is permitted to serve the respondents by private mode, in addition to regular mode of service, including service on the lawyer appearing before the trial Court and file affidavit of service by next date, failing which the petitioner shall deposit costs of Rupees Five Hundred with High Court Legal Services Sub-Committee, Nagpur.

Shri Naik, learned counsel for the petitioner has drawn attention of this Court to the Possession Letter at page 149 of the paper book to show that the possession of the flat has already been handed over to the respondent. It is submitted that, presently, the only issue of compliance of Clause (III) survives. It is the submission of the petitioner that such directions are erroneous, as no reasons are recorded.

In that view of the matter, till the returnable date, there shall be stay to Clause (III) of the impugned judgment and order dated 05/01/2024 passed by the National Consumer Disputes Redressal Commission, New Delhi in First Appeal No. 30 of 2020.
