Ms. Olive D’souza Advocate for the Petitioner submits that deceased left behind him last Will and Testament which was duly executed at Chennai on 30.05.2020. The said Will is in English language.

Ms. Olive D’souza, Advocate for the Petitioner submits that deceased was governed under the Hindu Succession Act, 1956. It is submitted that parents and wife of the said Deceased have predeceased the said Deceased. Petitioner's Oath is filed. There is affidavit of service filed by Sheriff Office dated 15^th April, 2024 showing service upon non-consenting legal heirs Shri R. Manoj (legal heir) and Smt. Kirthi Raghavan (legal heir). Affidavit of Shri B. A. Raju (alias Raju B.A.) and Shri B. Ramalingam S/o Govindaraj Baskaran, both the attesting witnesses to the Will are filed. Affidavit of service of General Citation is filed. All other legal formalities are complied with. Hence, Petition is granted.
